General Terms and Conditions

1. Scope of application

These General Terms and Conditions (GTC) apply to all deliveries from Dagmar Fett Artworks to consumers.
A consumer is any natural person who enters into a legal transaction for a purpose that can predominantly be attributed neither to their commercial nor their independent professional activity.

2. Contractual partner

The purchase contract is concluded with Artworks owner: Dagmar Fett, Drieschstr.28, 50374 Erftstadt, Germany

3. Conclusion of contract

3.1. The presentation of the products in the online shop does not constitute a legally binding offer, but only an invitation to place an order.

3.2. By clicking the button [Buy/order with obligation to pay], you place a binding order for the goods listed on the order page. Your purchase contract is concluded when we accept your order by sending you an order confirmation by e-mail immediately after receiving your order.

4. Right of withdrawal

4.1. If you are a consumer (i.e. a natural person who places the order for a purpose that cannot be attributed to your commercial or self-employed professional activity), you have a right of withdrawal in accordance with the statutory provisions.

4.2. If you, as a consumer, exercise your right of withdrawal according to Section 4.1, you shall bear the regular costs of the return shipment.

4.3. In addition, the right of withdrawal is subject to the provisions set out in detail in the following

You have the right to cancel this contract within fourteen days without giving any reason.
The cancellation period will expire after 14 days from the day on which you or a third party named by you, who is not the carrier, has or has taken possession of the goods.

To exercise the right of withdrawal, you must inform us [enter the trader's name, geographical address, telephone number and e-mail address] of your decision to withdraw from this contract by a clear statement (e.g. a letter sent by post, fax or e-mail).
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged for this repayment. We may refuse repayment until we have received the goods back and checked that they are intact.

You must return the goods to us or to (insert the name and address of the person authorized by you to receive the goods) without undue delay and in any event not later than fourteen days from the day on which you notify us of the cancellation of this contract. The deadline is met if you send the goods before the expiry of the fourteen-day period.

You shall bear the direct cost of returning the goods.

You shall be liable for any diminished value of the goods if they are damaged.

6. Delivery

1. 1. We deliver worldwide, free of charge for the buyer.

   2. The delivery time depends on the postal route and the country of the recipient.

7. Payment
7.1. Payment is made exclusively in advance.

7.2. If you choose to pay in advance, we will provide you with our bank details in the order confirmation and deliver the goods after completion and receipt of payment.

8. Retention of title

The goods remain our property until full payment has been made.

9. Warranty

Dagmar Fett Artworks is liable for material defects according to the applicable legal regulations, in particular §§ 434 ff of the German Civil Code.

10. Dispute resolution

The EU Commission has created an internet platform for the online resolution of disputes. The platform serves as a point of contact for out-of-court resolutions of disputes regarding contractual obligations arising from online sales contracts.
